1. Acceptance of Terms

By accessing and using the maia-botanicas.com website (the "Site"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not accept these Terms, do not use the Site.

2. Service Description

Maia Botánicas, a commercial brand of MAIA MANAGEMENT GROUP S.A.S., is a B2B dispensary of products for bars and restaurants: Japanese-technique ferments and sauces (koji, miso, tare), house-compounded Caribbean products (mango tuahine, black garlic, bitters, syrups), and bar glassware/tools sourced via import partners. Sales are wholesale only, to businesses. The Site is informational and commercial (B2B); orders are handled via WhatsApp.

3. Permitted Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. The following is prohibited:

• Copying, reproducing or redistributing Site content without written authorization.
• Attempting to access unauthorized systems, networks or data.
• Using the Site to transmit illegal, offensive or fraudulent content.
• Reverse engineering any Site software or technology.

4. Intellectual Property

All Site content — including texts, images, logos, described recipes, designs and code — is the property of MAIA MANAGEMENT GROUP S.A.S. or its licensors, protected by Colombian intellectual property law and applicable international treaties. No content may be used without prior written authorization.

5. Commercial Information and Pricing

Product information on this Site (including MOQ and delivery times) is illustrative. Wholesale prices, availability and specifications are subject to change without notice and are confirmed in the WhatsApp quote. Payments are processed via Wompi (Nequi, PSE, Bancolombia, card) or bank transfer.

Delivery promise ("The Botánicas Promise"): orders are dispatched to be delivered within 3 business days of payment confirmation, in served cities. If Maia Botánicas identifies that an item cannot be delivered within that window, it will inform the customer before processing the corresponding charge, and the customer may choose between: (a) a full refund or non-charge for the affected item, with a follow-up notice when it becomes available; or (b) a 10% discount on the affected item, with direct dispatch as soon as it is available. This promise applies to the affected item and creates no penalties beyond those described here.

Product origin: style descriptors (for example, "Japanese-style") describe a product's design or technique and are not a declaration of country of origin. The country of origin of each imported product is declared on its label and invoice, in accordance with Colombia's Consumer Statute (Law 1480 of 2011).

6. Certifications and Claims

Maia Botánicas does not claim to hold any health or quality certification that has not been formally granted. Products are made in accordance with applicable Colombian health regulations; any certification will be communicated only after formal issuance, with date and issuing entity.

7. Limitation of Liability

MAIA MANAGEMENT GROUP S.A.S. shall not be liable for direct, indirect, incidental or consequential damages arising from the use or inability to use the Site, to the maximum extent permitted by Colombian law. The Site is provided "as is" without warranties of any kind.

8. Privacy Policy and Data Rights

Personal data processing is governed by our Privacy Policy and Colombian Law 1581 of 2012 (Habeas Data). By using forms on this Site, you consent to the processing of your personal data for the purposes described in that policy.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Colombia. Any dispute shall be submitted to the jurisdiction of the competent courts of Santa Marta, Magdalena, Colombia, unless expressly agreed otherwise.

10. Modifications

MAIA MANAGEMENT GROUP S.A.S. reserves the right to modify these Terms at any time. Changes are effective upon publication on the Site. Continued use of the Site after changes are published constitutes acceptance of the new Terms.
